  1. Cherry Prepaid service may be used only if you have all of the following requirements.
    – a valid GSM 900 or multiband cellular phone handset.
    – a valid Cherry Prepaid SIM card.
    – Prepaid credits (refer to Prepaid user Guide for details on loading airtime value into the user’s account.)
  2. The Prepaid service cannot be used in the handset which (a) has been blacklisted by the service provider (Globe Telecom) due to the theft reports, loss, non-payment of the service and those alike; or (b) has been SIM-Locked for use only with the system of a GSM-CMTS operator other than the abovementioned service provider. Records of the service provider shall prevail over any dispute on eligibility of a particular handset for the use in line with the Cherry Prepaid Service. The service provider expressly reserves the right to SIM -Lock all handsets purchased from (please indicate) as part of a Prepaid Phone kit for use only with its own services.
  3. The Prepaid Service requires to purchase or acquire a Cherry Prepaid SIM card. This SIM card enables the use of a valid GSM900 or multiband cellular mobile phone handset for the Prepaid Service. The Cherry Prepaid SIM card that comes together with a Cherry Prepaid SIM Pack or Cherry Prepaid Phone kit contains an initial value. Once the initial value has been used, consumed or depleted such use of the service requires the subscriber to purchase a Cherry Prepaid Call & Text card or loading of value through electronic channels. This card denoted the airtime value to be loaded into your prepaid account. A Cherry Prepaid Call & Text card cannot be used to other Globe Prepaid SIM cards.
  4. The Cherry Prepaid SIM card will expire within sixty(60) days from its activation. In line with the continuance or availing of the Prepaid service, the subscriber needs to reload a Prepaid account within sixty(60) days from the date of activation. Moreover, in the event that no reloading of prepaid service has been done during the sixty(60) days period from the date of activation, The Cherry Prepaid SIM card will be terminated. Terminated Cherry Prepaid SIM cards will not be reactivated, and all mobile phone numbers assigned to such cards cannot be reacquired. Therefore, a purchase of new Cherry Prepaid SIM Pack is required to avail of the Prepaid Service. Cherry Prepaid SIM cards are non-refundable.
  5. All outgoing calls will be subject to Cherry Prepaid tariff rates prevailing as of the time the calls are made, plus applicable toll charges and taxes. International calls shall be charged at the exchange rate prevailing at the time such calls are made. The service provider reserves the right to change Cherry Prepaid tariff rates without prior notice. Any change in rates shall be effective immediately on the date of effectivity of the said Order of the National Telecommunications Commission (NTC) approving the same.
  6. It’s the subscriber’s responsibility to exercise extra-ordinary diligence to secure, safe keep and store cellular telephone handsets, SIM cards, and Call & Text cards, and ensure the security of your PIN and PUK codes. All outgoing calls made through the use of the SIM card shall be automatically deducted from the prepaid account and Cherry Prepaid nor the service provider will not entertain any claims for rebates and refunds due to use of unauthorized persons. Subscriber’s acknowledge and agree that it is inherent in the nature of the prepaid service that service provider cannot and will not give call details or itemized billing for call made through the use of any Cherry Prepaid SIM card. NOTE: The PIN (Personal Identification Number)/PUK (Pin Unblocking Key) letter contains SIM confidential codes (PIN1, PIN2, PUK 1 and PUK 2). Keep these safe. The codes protect you from unauthorized usage of your phone.
  7. The Cherry Prepaid SIM card and Cherry Prepaid Call & Text card are non-refundable and non-replaceable in the event of loss, theft, or damage due to misuse, mishandling, or negligence. Claims defects in the Cherry Prepaid SIM card or Cherry Prepaid Call & Text card shall be entertained if brought to Cherry Prepaid’s attention within seven (7) days from date of purchase and only if there has been no prior usage of the cards.
  8. Subscriber’s shall not use the Prepaid Service, handset, SIM card, or Call & Text card for any unlawful, fraudulent, illicit or abusive purpose. The service provider expressly reserves the right to terminate the service of any subscriber and those who exhibit abusive measures and usage as determined by the sole discretion of the service provider.
  9. The service provider will not be liable for any direct, indirect, consequential or other damages resulting from any failure in the Prepaid Service or for any loss, damage, theft, or misuse of the Cherry Prepaid SIM card, Call & Text card or any handset used as part of the Prepaid Service.
  10. This Cherry Prepaid SIM is powered by Globe Telecom, Inc.
  11. The service provider reserves the right to amend these terms and conditions at any time, with or without prior notice. Rates may change subject to the approval of the NTC.
  1. Demonstrate the value of CMCI’s Products and Services to potential subscribers.
  2. Actively pursue leads for potential subscribers.
  3. Be creative and find different solutions to satisfy the potential subscriber’s needs.
  4. Build relationships to potential subscribers and give proper customer service.
  5. Continue to work on learning new skills and sales strategies to increase sales.
  6. Shall observe all the following guidelines:
    • CUSTOMER ACQUISITION
      • In the event of any doubt in relation to your obligations and duties as SA and/or when any conflict situation arises, you are obliged to seek clarification from CMCI in writing immediately before you continue to execute your obligations and duties in such circumstances.
      • You shall promote, market and sell the Products and Services.
      • You are not allowed to verbally or in writing tarnish or adversely affect CMCI’s image and reputation and/or other SAs image and reputation to thepublic and/or any Customers in whatever means and circumstances.
      • Services and any Additional Items during the appointment period in the assignedTerritory.
      • When undertaking sales and pre-sales support, you shall also undertake and herebyagree to do the following:
        • Offer the Products and Services to the target market;
        • Ensure all registrations are made under the specific company or the names ofemployees of such companies or individuals;
        • You and your employees are strictly prohibited from carrying out any of the followingacts during the registration of Customers (as defined below):
        • Forging signatures on the Subscriber KYC or falsely submitting any Know Your Customer requirements.
        • Falsifying Customer’s documents or corporate information for registration purposes.
        • Using Customers’ documents or information without authorization.
        • Doing any other acts and/or conduct which in CMCI’s sole and absolute discretion is not in CMCI’s best interests.
    • POST SALES SUPPORT
      • You shall ensure that there is a dedicated customer service team that will support all post- sales activities, including but not limited to:
      • Advising Customers on the status of the Customer’s activation and new offerings on the Products and Services.
      • Ensuring no existing CMCI SIM is terminated with the intention of re-registering the Customer in order to enjoy any incentive or commission.
      • You are to refer to CMCI authorized MD or Sales Personnel if you are in any doubt of any post sales operations process and procedures.
    • PROMOTIONAL MATERIAL
      • All product catalogues, brochures, manuals and other publications used to assist you in selling the Products and Services shall be subject to CMCIs prior approval. You are not allowed under any circumstances to re-label or change the branding of any of the Products and Services in any manner whatsoever and shall not use or print any of the above materials for any other purpose except with prior written approval from CMCI.

1. COLLECTION OF CUSTOMER DATA

The Customer Data that we collect, process, use, and share are either Personal Information or Non-Personal Information:

    2. The location of your device whenever it is switched on, if you subscribe to location-based services, subject to coverage limitations; and

Your use of our network, your Internet Protocol addresses, network performance experience, diagnostics, such as signal strength, dropped calls, data failures, and other network performance issues, to help us improve our network and quality of products and services, improve your user experience, determine tailored content, create new products and services, and for other legitimate business purposes.
  • Non-Personal Informationis any information that does not identify you individually, and includes statistical or analytical data, and anonymized or aggregated reports.

2. YOUR RIGHTS AS OUR CUSTOMER

Cherry Prepaid recognizes that you, as our customer, should be the ultimate decision-maker on matters that involve your Personal Information. To this end, Cherry Prepaid is mindful of the fundamental rights of each Ka-Cherry Prepaid under the Data Privacy Act of 2012.

By consenting to the Terms and Conditions upon the availment of and continued use of any of our products and services, you, as a Ka-Cherry Prepaid customer, have agreed to the collection and processing of your Personal Information that will enable us to provide you with the requested product or service.

As a Ka-Cherry Prepaid customer, you have the right to be informed whether your Personal Information were, are, or will be processed. We can provide you with the general facts relating to how your Personal Information are collected, handled, and processed; provided that any and all such requested information, whether individually or taken together, does not amount to information deemed confidential or proprietary by Ka-Cherry Prepaid or the request is vexatious or unreasonable.

Once you have registered as our customer, you may access your account details and correct your Personal Information by contacting Cherry Prepaid Customer Care ((+632) 7909-4909 using your mobile phone) or your relationship manager, as may be applicable; or by visiting any Cherry Prepaid Store or our website at www.prepaid.cherry.com.ph. When you use our website and electronically communicate with us, depending on your settings, we may use cookies, web beacons, small data text files, or similar technologies to identify your device and record your preferences, with your consent. The completeness and accuracy of your information help us improve our products and services to you. Thus, we encourage or request you to update your Personal Information from time to time.

If at any time you object or withhold your consent to the collection and processing of your Personal Information, we will be constrained to terminate the requested product and service considering that without your Personal Information, we will not be able to deliver the said product and service. Further, we will be unable to provide you with any updates on Cherry Prepaid latest offerings, and you may be unable to participate in our events, promotions, or other activities.

The law also grants you the right to suspend, withdraw, or order the blocking, removal, or destruction of your Personal Information in our processing systems upon discovery and substantial proof that your Personal Information is no longer necessary for the purposes it was collected, and for such other cases provided in the Data Privacy Act of 2012.

During roaming or when availing of services offered by foreign service providers through our network, regulations different from Philippine regulations may apply to the storage, treatment, and transfer of your Personal Information.

We take paramount care in handling your Personal Information. You have the right to seek indemnity for damages sustained, if any, due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your Personal Information.

Should you feel at any point that there has been mishandling or misuse of your Personal Information, or that any of your data privacy rights have been violated, our channels are open for any such concern you would like to bring to our attention.   • Without limiting the generality of the foregoing, Customer Data is used to, among others:
    • Provide you with your subscribed products and services, including customer support;
    • Help us improve our network and quality of products and services;
      • Create new products and services;
    • Enhance your customer experience and determine tailored content to meet your preferences and needs;
    • Communicate relevant services and/or advisories to you;
    • Abide by any safety, security, public service or legal requirements and processes;
      • Process information for statistical, analytical, and research purposes. The use of your information for statistical, analytical, and research purposes enables us to create anonymized and aggregated insighting reports that we use to further improve your user experience and to provide new products and services;
      • Create a customer portrait based on your demographic, and your behavioral, transaction and interaction data across all products, systems, devices, and/or interaction channels, which we may use as basis for sending you commercial and promotional alerts, personalized advertisements, financial service offers, and surveys. To be clear, should we need to share data with third-parties for advertising and marketing purposes, we only share anonymized and aggregated data, and not your Personal Information;
    • Compute for a telco score which may be shared with our subsidiaries, affiliates, partners and/or third-parties, for various purposes such as, but not limited to, credit scoring, premium subscription offerings, product bundling, consistent with our goal to provide you with new products and relevant offerings to meet your changing needs; and
    • Comply with the requirements of the law and legal process, such as a court order; to comply with a legal obligation; or to prevent imminent harm to public security, safety, or order, collectively referred to as “Data Use Purpose”.

Our data processing is always in a manner compatible with declared, specified, and legitimate purpose. Data processing is also adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

We will ask for your consent when there is an additional processing requirement other than those we have outlined above.

When required by our Privacy Policy and the law, and before we collect, process, use, or share your Personal Information for any other purpose other than enumerated above, we will ask for your consent.

4. PROTECTION OF CUSTOMER DATA

We respect your privacy. We take paramount care in protecting your Customer Data. As such, we secure and protect your Customer Data with proper safeguards to ensure confidentiality and privacy; prevent loss, theft, or use for unauthorized purposes; and comply with the requirements of the law.

As Information Security threats continue to develop and evolve at such a rapid pace, we make reasonable and appropriate security arrangements and measures that use a variety of physical, electronic, and procedural safeguards to protect Customer Data. Cherry Prepaid runs a state of the art Security Operations Center with a dedicated team and personnel that monitors our network and systems to make sure risks to Cherry Prepaid and your data are properly managed. We regularly review our information collection, storage, and processing practices, including physical security measures, to guard against unauthorized access to our system and unauthorized alteration, disclosure, or destruction of information we hold.

We only permit your Customer Data to be collected, processed, used and shared by our authorized employees, contractors, and subcontractors who hold such information under strict confidentiality and in accordance with their contractual obligations and who have implemented minimum security features against data leakage, unauthorized access, or disclosure. We restrict access to information to Cherry Prepaid employees, contractors, and subcontractors who need to know such information in order to process it for us, who are subject to strict contractual and technical safeguards, and who are accountable if they fail to meet these obligations.

Furthermore, we only give you or your authorized representative access to your Personal Information. We are not responsible for information, content, application, product, or service that we do not provide. But because we care for you and protect you, we take measures to fight spam, fraud, or any unauthorized messages that traverse our network. Further, we will not tolerate the use of our network that violates the law, which shall include but not be limited to:

  • Photo or video voyeurism, including the publication or broadcast or transmission through our network of any sexual act or any similar activity without the consent of the person involved and under circumstances in which the person has a reasonable expectation of privacy, is prohibited and unlawful with corresponding penalties under the law.
  • Child pornography is also prohibited and punishable by law and our network shall not be used in any manner for the storage, transmission, or dissemination of materials containing child pornography.
